国际产品侵权责任的法律适用

伴随着经济全球化的进程,涉外产品责任纠纷案件日益增多,原有的一般侵权法律适用原则,已暴露出诸多滞后与不足。我国在此问题上仍保守于一般侵权的法律适用原则。应借鉴国外先进的立法经验,完善我国国际产品责任法律适用的国内立法,尽早与国际立法趋势接轨,适时加入《海牙产品责任法律适用公约》。

On the application of tort laws in international products

Along with the process of the ecnomic globalization,foreign-related cases on the liability of product are on the rise.The original general application principles of tort law,have exposed a lot of lag and defects.China on this issue are still conservative in the original general application principles of tort laws.Learning from advanced foreign experience on legislation and improving the domestic legislation on the application of the internationl product liability law,so as to make it into the line with the internationl legislation trend,join in the Hague Rules.
