反不正当竞争法律制度的完善

近年来,我国市场经济得到了迅速发展,市场体系日趋完备,市场竞争日益激烈,一些新的不正当竞争行为逐渐暴露出来,有的表现还很突出。相比之下《反不正当竞争法》规范的不正当竞争行为、执法手段、法律责任等与现实经济生活存在着明显的不适应。目前,我国反不正当竞争法律制度的缺陷主要包括：缺失一般条款规定、不正当竞争行为涵盖不全、法律条款的操作难度大、执行条款缺乏强制性、执法主体规定缺乏唯一性等。应从以下几个方面解决：增加对新的不正当竞争行为的界定、加强《反不正当竞争法》的可操作性、强化反不正当竞争的执法手段、划清反不正当竞争的执法权限、加大处罚力度,增加惩罚性处罚条款。

The perfection anti-unfair competition law system

In recent years,the market-economy has been developing rapidly in China,becoming more and more perfect.With an increasingly competitive market,a number of new acts of unfair competition are gradually exposed,and some are very outstanding performance.In contrast,the ＂Anti-Unfair Competition Law＂ which regulate the acts,such as the acts of unfair competition,law enforcement tools,and legal responsibilities,can′t adjust to the reality of economic life clearly,which reveal a number of issues,and affect the normal market economic order to some certain extent.This situation makes promoting legal system of anti-unfair competition imminent.At present,the main defects of the ＂Anti-Unfair Competition Law＂ include： the loss of general terms,the acts of unfair competition not fully covered,the great difficulty in manipulation of the law terms,the lack of enforcement in terms,the shortage of the uniqueness in law enforcement main body.Based on that,the author thinks that the problems can be solved from the following aspects： to put additional definitions to the new unfair competition acts,to strengthen the manipulation of the ＂Anti-Unfair Competition Law＂,to enhance the enforcing methods against unfair competition,to make clear the limits of the power in fighting unfair competition,to increase the strength of punishment,and to add some penalty terms.
