| 摘 要： | 我国现行法对计算机软件的保护是一种由著作权法，专利法，商标法，反不正当竞争法和商业秘密法综合保护的模式。这一模式应和了世界潮流，但其存在的漏洞与不足也是显而易见的。因此，应在吸收国外先进经验的基础上，根据我国国情，对之进行修正和完善。

| Abstract: | Our present law on the protection of computer software is a mode which combines Copyright Law, Patent Law, Trademark Law, Anti - injustice Competition Law and Commercial Secrets Law. This node has its obvious disadvantages although it confirms to the world trends. We should make some adjustments of it according to our domestic situation on the basis of absorbing the advanced foreign experiences. |
