试析专利权穷竭原则及其相关问题——兼析我国《专利法》的完善

中国加入世贸组织以后，专利产品平行进口引发的国际贸易争端将不断增加。专利产品平行进口的依据是专利权国际穷竭原则，而我国专利法对该原则没有做出明确规定。本文拟对专利权穷竭原则的有关理论、有关国家立法及国际条约对该原则的立法态度、我国的完善对策进行阐述。

An Analysis of the Exhaustion Principle of Patent and its Relevant Problems

The basis of parallel import of patent products is the principle of international exhaustion of patent, but Chinese patent law doesn''t clearly provide the principle. This essay analyzes the exhaustion principle of patent, the legislative attitude of relevent countries and international convention, and also puts forward some suggestion on the improvement of our patent law.
