试论旅游合同违约之精神损害赔偿

根据传统民法，精神损害赔偿只能囿于侵权责任，而不能作为一种违约责任的救济措施。本文通过对我国《民法通则》和《合同法》的扩张解释，认为在旅游合同这类特殊性质的合同违约中，可以确立精神损害赔偿制度，以加强对受害方旅游者的保护。从而突破传统的债权责任体系，完善违约责任形式

On Mental Compensation in Breach of Tourist Contract

According to the traditional civil law, mental compensation is only regarded as one of relief measures resulted from tort, not applied in the cases of violating contracts. However, after having put an extensive interpretation on uniform rules of civil law and contract law, the article holds that mental compensation system should he established in tourist contract so as to safeguard the lawful rights and interests of tourists effectively. For this purpose, the article aims to make a breakthrough at current obligatory rights system and perfect the system of liabilities for breac of contract.
