环境平等权探析

本文从环境权的基本概念出发，从生态性环境权和经济性环境权两方而，分别对环境权的代内平等和代际平等进行论述:这种平等不是结果的平等，而是权利义务的平等，自然环境权是人权的组成部分，因而是人人平等;理想的、独立封闭的环境系统间的环境权是平等的，这是因为:环境系统间无利益的交流，无利益主体人的交流，无环境污染破坏存量的交流。现实的、开放的环境系统间的环境平等权不是绝对的，任何获取利益的主体，只有在其承担的环境治理义务范围内享有相应的环境权，这种环境平等权方可存在。而现实中的平等是相对的，更多的是不平等，为最大程度的实现该平等权，本文提出了对环境平等权的系列法律保护措施。
