西南民族地区乡村生态振兴法治保障研究#br#

2022年1月，新国发2号文件对贵州提出“全面推进乡村振兴，加快农业农村现代化”的新时代要求，也为西南民族地区在乡村振兴上闯新路、开新局指明方向。改革创新，需立法先行。通过考察发现，目前我国西南民族地区乡村生态法治建设面临多重现实困境，主要表现为乡村居民参与生态治理意愿不强、生态环境保护法律法规供给不足、司法保障机制运行不畅、执法监督质效较难保障等。因此，西南民族地区乡村生态振兴法治保障应立足于西南民族地区社情乡情与资源优势，以习近平生态文明法治思想为引领，以人才振兴和科技振兴为支撑，通过健全乡村绿色生态立法体系、完善乡村绿色生态司法保障机制、强化乡村绿色生态执法监管职能等路径寻求破局之道。

Research on the legal guarantee of rural ecological revitalization in Southwest minority areas

In January 2022, No.2 Document of State Council put forward the new requirements of “comprehensively promoting rural revitalization, accelerating agricultural and rural modernization” for Guizhou in the new era, and also pointed out the direction of innovation and opening new bureau in rural revitalization in southwest minority areas. Reform and innovation requires legislation first. Through investigation, it is found that the rural ecological rule of law construction in southwest minority areas of China is faced with multiple practical difficulties, which are mainly manifested as weak willingness of rural residents to participate in ecological governance, insufficient supply of laws and regulations for ecological environmental protection, poor operation of judicial guarantee mechanism, and difficult to ensure quality and effectiveness of law enforcement supervision, etc. Thus, the perfect path of rural ecological revitalization of rule of law guarantee in southwest minority areas should be based on the social actual situation and resource advantages, guided by the Xi Jinping Thought on ecological civilization of rule of law, supported by the revitalization of talent and scientific technology, establishing rural green ecological legislation system, perfecting the judicial safeguard mechanism, and strengthening the law enforcement supervision function.
