| 摘 要： | 布尔迪厄认为不同的资本带来不同的权力。在司法过程中,不同当事人具有不同的资本,进而影响叙事能力的强弱。只有具有较强资本的当事人,才能够通过叙事来重构对自己有利的案件故事,进而说服法官,使自己的利益诉求得到司法保护。

| Abstract: | Bourdieu has an idea that different capital brings different powers.In the judicial process,each litigant has different capital,which affects the strength of narrative ability.Only litigant with strong capital is able to reconstruct the story of the case to his advantage through the narration,and then to protect his interests by persuading the judge,to protect their own interests with judicial protection. |
