为了解决当前中国在城市房屋拆迁征收与农村土地征收中的制度与政策差异导致在不动产征收过程中出现的一系列问题。运用伦理学和法理学的系统分析方法,对中国城乡分割的不动产拆迁与征收相关法律进行了研究。结果表明:(1)当前中国不动产拆迁与征收制度主要存在集体土地所有权主体弱化、城乡土地用益物权征收与补偿标准不一致、征收公共目的性依据不足、补偿标准理论依据欠缺、征收补偿程序缺乏司法救济等问题;(2)现行中国财产权法律保障体系为城乡统一的不动产拆迁与征收制度构建提供了坚实的产权法理基础、补偿标准同一化基础与现实基础;(3)通过不动产物权权能构成与性质完善、不动产拆迁与征收程序等法律规范和补偿评估标准的改革。建立城乡统一的不动产拆迁与征收制度,可以充分有效的保障被征收人的核心利益,从制度上解决土地征收与房屋拆迁中的激烈矛盾和现实问题。  相似文献

Recently,many large and medium-sized real estate companies in China have attempted to construct a standard project management system regarding project culture,organization and value chain,to enhance their ability of integrating resources and effectively delivering projects.An appropriate definition of project phases is the base of standard management for these enterprises.According to the existed literature and the observation of some real estate companies,a Six-Phase(SP) approach is presented.The method standardizes real estate project in China by dividing a project life cycle into six phases.A case study shows that the six phases correspond appropriately with those suggested by the departments of four real estate companies.An industry survey by means of questionnaire has also been conducted.The respondents,most of which are the CEOs from 50 real estate companies in China,agreed that this approach is reasonable and acceptable.  相似文献

After China's entry into WTO, some well-rounded foreign real estate agencies and home financial company have entered into China's real estate market. Encountered with gradually matured market, the real estate enterprises pay more attention to the issue of how to preserve the biggest profit space. In this paper, the cost management will be investigated deeply and related measures will be put forward. This paper follows the principle of standing out the emphasis and exploring deeply the essential problem. With the theory-coupled-examples method, the fundamentality of cost management in decision-making and programming design stage is studied. The object system method is used to evaluate the quality of the decision-making and using compound engineering designing principle to manage the cost. The results prove that the decision-making as well as programming design stage is the key of cost management, which should be taken seriously by China's real estate enterprises.  相似文献

Whether the international economic and financial environment pressure or domestic economy grows dynamical inadequacy suggests that the economy may enter a downward cycle in 2012. Policy is still the most important factor which will determine the trend of the real estate market. In the face of tighter monetary environment, limiting the purchase, credit limit, limit and strict regulation of real estate and the rapid growth of the low-income housing supply, housing price quantity fall into a downward trend, market situation is complex and severe. Although it is not long since the Chinese real estate appraisal agencies appeared in China, they have been developing quickly. With the increase of real estate appraisal portfolio, the number of real estate appraisal agencies in the market also increases. However, because of the loose management in this field, there are many operation that are not standard and not allowed by the operating rules. The influence of the reform on Chongqing Real estate enterprises by analyzing the problems existed in real estate development in Chongqing is expounded. In this paper the concept and active impaction on economy of timeshare were introduced. According to supply, demand and basic condition, developing timeshare estate were provided with basic condition in China. Analyzing the history of timeshare we can get the conclusion that it was unused real estate to startup the timeshare and so the development of timeshare in China have partly active effect. At last, in this paper the policy risk, consumption anticipation risk, lack of demand risk, product design risk, market orientation risk, system management risk, competition risk, internationalization risk, and market impression risk were analyzed except the market risk, business risk and polity risk and so on which were the common risks of real estate. With the implementation of the policy for house monetarization,the real-estate guaranty company develops quickly in our country.However,there exist many problems as it is a newly emerged thing in financial system of real estate.The problems are as follows: the estate security company is defined as a medium agency in legislature,which does not conform to its feature as financial business;the local restrictions will cause the decrease of credit,weakness in risk-taking capacity and supervision of the company.Such predicament hinders the development of the guaranty company seriously.In order to resolve these problems, the crucial way is to clarify the status of the guaranty company as a non-bank financial institution,and to set up a national guaranty company to offer official security to the people of low income and enhance internal and external supervision.Only through these steps can we realize the functions of the guaranty company for real estate and give full play of its potential function.  相似文献

论述了国外欧美等发达国家信息技术在土壤养分管理和施肥技术上的运用特点,分析了中国测土配方施肥对信息技术的要求、发展趋势,提出了中国目前测土配方施肥信息化处理的要求、任务和内容,分析了县市农业技术推广部门在测土配方施肥运用信息技术存在的问题。测土配方施肥中信息技术的运用主要包括:(1)应用数据库技术和地理信息系统,按照标准处理和整理土壤肥料等数据和相关图件,建立属性数据库和空间数据库与管理系统;(2)利用地理信息系统和基础数据库,结合应用模型,建立耕地地力评价系统、施肥决策系统等测土配方施肥应用系统;(3)将网络技术与已建立的应用系统结合起来,实现数据库的共享化和测土配方施肥的网络化。  相似文献

Two problems often appear in estate auction.The first is to whom the buyer can claim cancellation of the contract,if he can't get the estate.The second is whether the tenant can still claim his priority to the estate.In auction,we can't use the principle of agency,fiduciary and mediation to explain the relations among client,auctioneer and buyer,because it doesn't accord with the auction practices and the Action Law section 40.The undisclosed agency in Contract Law may be an adapt explanation to the relations.According to the law hermeneutic,we should narrow the scopes of the tenant priority and exclude it from auction.  相似文献

Enhancing dry matter production with higher partitioning to fruit bunches is important for sustainable intensification of oil palm. A series of best management practices including site-specific nutrient management, canopy management, and harvesting has been developed for oil palm plantations. However, the effects of these practices on dry matter production and partitioning, and how the effects vary with climatic and soil conditions of plantation sites, remain largely unknown. We established a four-year field trial including 30 paired commercial blocks across Sumatra and Kalimantan, Indonesia. The paired treatments included site-specific best management practices, and standard estate practices as the control. The annual production of aboveground dry matter was 30.0 ± 0.5 t ha−1 yr−1 (mean ± se) under best management practices, higher than 28.8 ± 0.5 t ha−1 yr−1 under standard estate practices. The bunch index, an indicator of the fruit production efficiency, increased by 12% under best management practices compared to standard estate practices. Partitioning of dry matter to the fronds decreased by 8% under best management practices, compared to standard estate practices. The positive effect of best management practices on the annual production of total aboveground dry matter was stronger in the plantation site with higher annual rainfall. These results are useful for optimizing management practices to improve sustainable intensification of oil palm.  相似文献

A. A. Markov Rolling Forecast Method is presented in this paper according to the dynamic characteristics of the estate business system. Test results reveal that the system quantitative forecast could be realized on the basis of previous samples, which provide a direction of the rational management in estate business. Concerning sample molding analysis and Markov Rolling Forecast Method, this paper gives a corresponding conclusion of analytic research quantitatively in order to demonstrate the formation of factors working in estate business activities and its systematic logistic connotation. Markov Rolling Forecast Method can be applied not only to short-term prediction but long term one as well, provided when the market is rather stable with no significant change during a regular period of time and when the rolling times of the state transition matrix are fairly enough.  相似文献
