侦查监督机制的现状分析

侦查监督作为检察机关法律监督职能的一部分．对刑事诉讼活动的正常运行至关重要。但在司法实践中，侦查监督却存在诸多问题，如立案监督缺乏操作机制与程序保障、撤案监督无章可循以及强制措施监督缺乏等。要解决以上问题，发挥侦查监督的保障作用。文中认为通过建立刑事立案备案、撤案备查及强制措施的事后备查制度，赋予检察机关一定的机动侦查权，检察机关当前面临的问题与困境能得到很好地解决。

On the Current Situation of Investigation Supervision Mechanism in China

Being part of the function of legal supervision, supervision of investigation plays a crucial role in the regular activities of the criminal procedure. In practice, however, many problems exist in the supervision of investigation, such as lack of operating mechanism and procedural safeguards in the supervision of filing a case for investigation and prosecution. There is no regulation to follow in the supervision of dismissing the case and no supervision over the coercive measures. In order to solve these problems, a system of examining after filing, dismissing the files and coercive measures should be established and the procuratorial organs should be granted the right of initiative investigation.
