以法律文书写作学回归法学为视角的法学发展趋势

从西方历史看，法学沿着两条线索发展；法律家的法学或专业法学家的法学。法律家的法学运用一套法律家创制的法律语言，沿用来自法律家经验的解释方法，完成法律实务之问题解答，以追求实践一技术的知识积累的法律文书写作的研究便顺应了这一法学发展的需要；法律文书曾一度沦为写作学的分支，几经磨难，现又重归法学殿堂。法律文书作为一。门法学的主干课程，一种由程序法明确规定的司法技术，以其回归过程进行研究的目的，是为了重视和加强对它的理论研究，把握法学发展的趋势和方向，完善和改革司法实践，再造法学的理论生命力。

Development Tendency of Jurisprudence in View of the Return of Legal Document Writing Science to Jurisprudence

In the history of the western world, jurisprudence developed along two trails： one followed by the templar jurists and the other by the professional jurists. Jurisprudence of templar jurists uses a set of legal language created by templar jurists and explanation methods coming from their experience to fulfill problem solution of law reality, so as to seek knowledge accumulation of practice and technique. The study of legal document writing complies with the need of this jurisprudence development. Legal document science was once reduced to a branch of the general writing course and has now returned to the jurisprudence hall. Legal document science is one of the main courses of jurisprudence and one of the judicial techniques defined by procedural law. The purpose of our study of the return of legal document science is to emphasize and strengthen its theoretic study, to hold the tendency and direction of jurisprudence development, to reform and consummate judicial practice, and to reconstruct the theoretic vitality of jurisprudence.
