| 摘 要： | 随着科学技术的进步，人类用海活动日益频繁，用海方式不断增多，海洋经济价值日益彰显，各种错综复杂的海域使用制度应运而生。本文对海域使用权的概念、性质、海域使用权与其他用海权利之间的关系、海域使用权市场机制以及海域使用权分层确权等方面的研究进行了综述，展望了海域使用权研究的发展方向，认为海域使用权的分层确权是提高海域利用效率的主要途径。

| Abstract: | With the progress of science and technology, the marine is increasingly and frequently used by people. The value of marine economy is increasingly obvious. Various complicated systems for the usufruct of sea areas were born. The paper reviewed the concept and characters of the sea＇s usufruct; the relationship between the usufruct and other rights; the market mechanism of usufruct and separating usufruct into several layers. Finally, the paper discussed the developing trend of rights to use sea areas. |
