| 摘 要： | 通过近3个月的考察学习，对美国的植物知识产权保护体系有了全新的认识，植物品种权、植物专利和实用专利这3大保护形式的共存是美国国情所决定的，具有历史渊源和现实意义。了解美国植物知识产权保护体系的发展历程、审查方式及面临的挑战，以期为完善我国植物知识产权保护体系提供参考。

| Abstract: | This article is based on the three months studied in America. It is concluded that the protection system of plant intellectual property is very different from China. The protection system of plant intellectual property includes plant variety property, plant patent and utility patent. It depends on the situation and development of country and benefits of different groups. The knowledge of the protection system about America, will be a good reference for the development of protection system of plant intellectual property in China. |
