我国南方集体林区林权民事纠纷司法现状考察——以浙江省为例

摘    要:随着林权纠纷在我国南方集体林区多发,林权民事纠纷进入司法审判程序的现象日趋明显,司法裁判在解决南方集体林区林权民事纠纷中发挥着越来越重要的作用。文中通过对516份浙江省各人民法院林权民事裁判文书的收集统计与分析发现,林权民事案件不仅具有普通民事案件的共性,还因其生态与社会属性而有其自身的特点;在此基础上剖析了林权纠纷在司法审判实践中存在的瓶颈难题,以期推动南方集体林区林权民事司法水平的提升。

Abstract:With the increasing forest rights disputes in southern collective forest area,it is more and more evident that people would like to settle the civil forestry disputes with judicial process,and therefore the judicial trial plays a more important role in settling civil disputes for forest rights in southern collective forest area. This article collected and analyzed 516 civil jurisdiction instruments in relation to forestry in Zhejiang Province,and found that the civil cases in forest rights have been not only in common with the ordinary civil case,but also have the specific character due to their ecological and social nature of forest rights disputes. On this basis,it analyzed the bottleneck problems in the judicial trial of forest rights disputes so as to promote the improvement of the civil judicial level for forest rights in the southern collective forest area.
