| 摘 要： | 正确处理权争议（指林木、林地所有权和使用权争议)对于保证林业正常发展具有重要意义，在林权争议的政府处理程序和诉讼程序中，亟待解决法律规范的具体适用问题，本文在解释法律适用概念，可供选择适用的规范性文件的基础上，提出了处理林权争义的5条适用原则。

| Abstract: | It is very important for assure the normal development to maintain a proper treatment on forest land right. Detailed applications of legal regulations need to be resolved in the government treatment and lawsuit procedure. On the basis of explain of legal regulation application, selection of suitable documents, 5 applicable principles for the treatment of disputed forest land right were recommended. |
