| 摘 要： | 物权法规定的地役权与相邻关系是两种相似的法律制度,都涉及对他人不动产的利用。二者既有联系,又相对独立,在实践过程中,极易滋生歧义。本文对二者的制度演进、共同特征、具体区别三方面进行分析与探讨,为读者实践中更好的把握二者的尺度提供参考。

| Abstract: | The easements and adjacent relation in property law are two kinds of similar legal systems,and both involve the use of real property of others.In practice,there are connections in both,but also relatively independent, and very easy to produce ambiguous.In this paper,the evolution of both systems,common features,specific difference of both are analyzed and discussed,and provide the references for readers better to grasp the scale of both in practice. |
