制度的形成、产权与农地流转

运用制度形成原理及产权理论解释了我国农地流转制度形成的困境,地方集体组织与政府、农户之间相悖的利益关系以及农户残缺的农地产权是农地流转发展缓慢的主要原因。地方集体组织利用职权通过对农户农地产权的侵蚀以达到自身利益最大化的行为已经严重阻碍了农业的发展,依靠政府的力量变革农村中的部分生产关系、削弱地方集体组织的权利是农地新制度形成的关键所在。

Institutional form, property rights and transition of agricultural land

Based on institutional form and property rights theory,this thesis analyses the puzzle of the institution of transition of agricultural land.Inconsistent interest relation among local collectivity organizations,governments and farmers,and incomplete land property rights are the reasons of slow development slowness of transition of agricultural land.In order to make most benefit, local collectivity organizations corrode farmers' land property rights through authority,which has serious impact on agricultural development.So the focal points of agricultural land institutional change are to transform part production relation in the country and weaken the rights of local collectivity organizations.
