一起受淹大麦经济损失农业司法鉴定案例分析

分析了一起因农田淹水导致乳熟期大麦产量经济损失的司法鉴定案件,认为淹水对此期大麦的单位面积穗数、每穗粒数基本上无影响,但对千粒重有直接的影响,因此依据千粒重降低率与产量降低率相同的数量关系估算了受淹大麦的产量损失量。根据大麦的平均市场价格、生产成本投入等估算出受淹大麦的经济损失。本司法鉴定意见经质证后成为法院公正审理案件的法定证据。

Analysis of An Agricultural Judicial Identification Case of Flooded Barley Economic Loss

The author analyzed an agricultural judicial identification case of barley economic loss caused by farmland water- flooding at barley＇s milk - ripe stage, and thought that the waterflooding had little influences on the number of spikes per unit area and the number of grains per spike of barley, but it had direct influence on the 1000 - grain weight. Thus, according to the numeri- cal relationship that the reduction rate of 1000 - grain weight was equal to that of yield, we estimated the yield loss of flooded bar- ley. In addition, based on the average market price, the input of production cost and so on, we calculated the economic loss of floo- ded barley. After cross - examination, the judicial identification opinions we obtained became the legal evidence for court hearing of this case.
