从权力来源看土地征收权配置改革

权力性质及其来源,才是决定权力如何配置和行使的根本依据。回归权力的本原,才能找到真正制约权力的途径和方式。因此有必要从权利与权力的关系出发,对土地征收权的来源、性质进行梳理,在此基础上,对土地征收权的配置进行改革。土地征收权来自于人民赋予国家的在公共利益的前提下对土地资源进行支配的权利,应重新设定征地申请人的范围,回收征地申请权,并结合农用地转用审批权的配置改革下放土地征收权到地方人民政府,在审批环节引入公众参与机制共同认定公共利益项目,同时,改革征地强制执行的主体,完善司法救济程序。

The Power Disposition Reformation of Land Expropriation Seeing from the Source of Power

The nature and source of power is the fundamental basis for determining power configuration and implementation.Starting from the relationship between right and power,the source and property of land expropriation power was reviewed,on the basis of analyzing the fundamental problems,the configuration of land expropriation power was reformed.Land expropriation power is from the power that people confer to government to administrate the land on the premise of public interest.Therefore,some countermeasures should be taken,such as redefining the range of applicant,withdrawing people＇s application right of starting land expropriation,transferring expropriation power to lower government,introducing public participating mechanism to the public interest identifying link and changing the compulsory execution subject.
