我国农业植物新品种保护的现状与对策研究

在分析我国农业植物新品种保护的基本现状和存在的主要问题的基础上,有针对性地提出了对策建议。植物品种权法应由立法机关以法律形式公布,扩大品种权的保护范围,做到植物新品种法、专利法和种子法之间的相互协调,品种保护与品种审定之间的相互协调,行政保护与司法保护之间的相互协调,从而加大司法保护的力度,提高对植物新品种保护的水平。

Current Situation of the Protection of New Plant Variety and its Countermeasures in China

In the paper the current situation of the protection of new plant variety and existing primal problems were analyzed.Some countermeasures that the law protection of plant variety should be promulgated was put forward and the plant protection field of new variety should be expanded and the coordination among the law protection of new plant variety,the Patent Act and the Seed Law,and the examination and approval of new plant variety;the administrative protection and the judicial protection should be reached.We should improve the standard on the protection of new plant variety to enhance the judicial protection.
