农业生态环境保护与“基因污染”防治的法律规制探析

随着现代生物技术,尤其是基因工程技术的高速发展,所引起的"基因污染"是唯一一种可以不断增殖和扩散的污染,其污染传统作物,可能增加害虫抗性和对农业生态环境造成不可逆转的危害。通过分析"基因污染"对农业生态环境可能产生的风险,在剖析我国农业生态环境保护现状的基础上,探析我国在农业生态环境保护方面,关于"基因污染"防治在法律规制层面上存在的缺乏可操作性、强制性和时代性等问题;相应地提出了健全我国"基因污染"防治的法律规制构想。

With modern biotechnology,particularly the rapid development of genetic engineering technology,arising out of the "genetic pollution" is the only continuous proliferation and diffusion of pollution,"genetic pollution"contaminates traditional crops.by analysis"genetic pollution"giving the agricultural ecological environment to bring possible risk,in the analysis of the agricultural ecological environment protection status of foundation in China,exploring China in agricultural environmental protection about"genetic pollution" prevention and control of the existence of operability,mandatory,time and so on in level of the legal regulation.accordingly and thus puts forward sounding the idea of "genetic pollution" legal regulation of the prevention and control in China.
