| 摘 要： | 以往农村土地制度的根本缺陷在于:由于土地产权的缺陷,导致了土地物权的虚置和缺失,进而造成了土地流转、土地征用的制度性缺失,从而导致了土地产权模糊、土地流转困难、土地价值低估和补偿标准过低,这些缺陷严重阻碍了新生代农民工的市民化进程.因此,为了促进新生代农民工市民化,农村土地制度改革必须按照有利干明确和保护土地物权的思路,建立以承包权为核心的农地产权制度、基于承包权的农地流转制度和基于土地物权的农地征用制度.
