林权争议的参与式调解方法

林权争议是当前我国森林资源保护工作中的一个突出问题,及时有效地化解林权争议,对于维护权利人的合法权益,保护森林资源,促进林业发展,构建和谐社会,都具有十分重要的意义。传统的林权争议调解方法存在着违背自愿、自治原则,"法、理、情"不能有机结合,解决程序不够科学、规范等缺陷,因此往往不能从根本上解决问题。文章讨论参与式调查方法在林权争议调解中的应用,提出了林权争议参与式调解方法的设计:参与式工作理念,参与式工作方法,参与式争议解决程序,并同时指出其应用中应注意与乡村综合发展紧密结合,激励机制和外部支撑体系建设等3个问题。参11

Exploration of a participative mediation method for disputes on forest property

Disputes on forest property have been recognized as an important issue in the protection of China's forest resources in recent years.Effective and timely settlement to these disputes are of critical significance in defending obliges' legitimate interests,preserving forest resources,promoting the development of forest industry as well as building a harmonious society.However,traditional efforts failed to provide fundamental solutions because the principle of willingness and self-governance was violated `law,ethics,and compassion' couldn't be synthesized and the sttlement procedures were not scientific and standardized.The authors attempt to apply the method of participative investigation in resolving the disputes on forest property.The participative mediation mechanism is propsed as participative working principle,participative working method,and participative procedures in resolving the disputes.Three issues in application are also proposed.[Ch,11 ref.]
