论我国种子企业科技创新主体的法律支持

种子企业作为现代农业发展的主力军，是种业科技创新的主体。传统的农业高等院校、科研院所为主体的种业科技创新体制无法适应现代种业科技创新和发展的要求。种业核心竞争力关键在于具有较强的自主创新能力，使科学技术和成果迅速而有效地转化为生产力。当前我国种子企业在科技创新上所发挥的作用太小，自主创新能力薄弱，主要受困于法律地位、人才、科研体制、经费等问题，要改革传统的创新模式，使种子企业真正成为科技创新的主体，必须从政策法规、财政金融、科研人才、知识产权以及协同创新等方面为种子企业的发展壮大提供法律支持。

Legal Support for Enterprises centered Scientific and Technological Innovation in Seed Industry in China

Seed enterprises, the main force in the process of developing modern agriculture, are supposed to play a principal role in scientific and technological innovation in seed industry in China. The traditional innovation system with agricultural institutions of higher education and research institutes as the subject cannot meet the needs of scientific and technological innovation and development in modern seed industry in China. The core competitiveness of seed industry lies with a great capability of independent innovation, so that science and technology can turn into productivity quickly and efficiently. However, the current seed enterprises in China are actually of little importance in innovation practices and lack of innovation capability, most of which are troubled with the problems of legal status, talents, scientific research system and funding. To reform the traditional model of innovation and to make seed enterprises turn into the real subject in the process of scientific and technological innovation, government ought to support them by providing with policies and regulations, fiscal and financial help, scientific manpower, intellectual property and collaborative innovation.
