农村土地承包经营权确权登记颁证工作的现状及对策研究

2008年以来，农村土地承包经营权确权登记颁证试点范围逐步扩大，取得一批宝贵的经验和改革成效。但是，随着试点工作深入推进，实践发现在确权登记颁证准备工作中的几个操作难题、经营权期限的确定、增量土地的适用、土地经营权财产性功能挖掘等四个重点问题需要进一步厘清。如果能够有针对性分类解决操作问题，把农户的承包经营期限给予固定化、长期化，明确特殊情况下的调整情形，在此基础上，研究出台后续配套制度政策，对于增量土地逐步调整适用，探索丰富经营权实现形式，确权颁证登记工作的实效将得到进一步增强。

Present Situationof and Countermeasures for Confirmation and Registration of Rural Land Contractual Management Right

Since 2008,pilot confirmation and registration of Rural Land Contractual Management Right have been expanded gradually in scope and much valuable experience and a series of reform results have been achieved. However, as the work deepens, four major problems appear in the preparation of confirmation and registration of the right that need further efforts to clear up: difficulties in operation, confirmation of time limit of the right, application of incremental land, and exploration of the function of the right in property. Therefore, difficulties in operation should be targeted, sorted out and solved, time limit of the right be immobilized and made into a long term practice, and adjustment of time limit in specific situations be clarified. On such basis, follow-up supporting systems and policies should be studied and formulated, application of incremental land be adjusted, and forms to achieve the rights be explored and enriched so that substantial results of confirmation, certification and registration of the right could be further strengthened.
