| 摘 要： | 在执行实务中,由于立法上的缺陷和执行中止的随意性太大,过多的适用中止执行导致了大量的执行积案,使执行法院背上了“包袱”;同时,现行的执行中止制度承载了执行当事人过多的误解和不满。本文从执行中止事由的纯化、执行观念的更新和债权凭证制度的构建等方面为建立新的执行中止制度提出了具体的设想。 |
