拒不支付劳动报酬罪的司法困境与出路

自拒不支付劳动报酬行为被写入《刑法》以来,以"拒不支付劳动报酬罪"定罪处罚的案件逐渐增多,司法实践中存在的一些问题也比较突出。由于现行立法对于本罪犯罪主体、劳动者、劳动报酬范围以及主观故意、支付能力、其他严重后果如何界定等内容的规定不甚明晰,导致实务中个案的认定存在差异。对拒不支付劳动报酬罪入刑的刑法取向进行法理分析,结合本土国情,建设性地提出本罪司法困境症结的破解对策,为劳动者合法权益提供刑法保障,维护社会经济政治秩序的稳定。

Judicial Dilemma of the Crime of Refusing to Pay Laborers Wages and Its Solution

Since the behavior of refusing to pay laborers wages is written into the Criminal Law, relevant cases gradually increase and some prominent problems emerge in judicial practice. Because current legislation does not give clear definitions to the subject, laborer, wage, subject intent, paying capacity and other serious circumstances, the identification of the crime is different in some cases. By analyzing the criminal law orientation of the crime and taking China''s national situation into consideration, this paper attempts to put forward a solution to the judicial dilemma of the crime, which might help to provide criminal law protection for the legal rights and interests of laborers, and maintain the stability of social, economic and political order.
