粮食综合生产能力建设资源环境立法保障研究

粮食综合生产能力是农业综合生产能力的核心基础，是确保国家粮食安全、促进国民经济协调发展的有力保障。然而，在当前国家粮食安全面临新挑战的情况下，中国粮食综合生产能力建设资源环境立法保障在立法指导思想、立法保障体系、市场机制建构、立法保护力度等方面存在诸多缺陷。为保护涉粮自然资源与生态环境进而提升粮食综合生产能力，中国必须在可持续发展观与资源环境安全观的指导下，完善涉粮资源环境立法保障体系，积极建构涉粮资源环境市场机制，加强涉粮资源环境立法保护力度。

The comprehensive grain production capacity is the core and basis of the overall production capacity of agriculture and an effective guarantee of national grain security and national economy coordinated development. However, in the circumstances of the present new challenges for national grain security, there have been many flaws in the legislative guiding thought, the legislative protection system, the market mechanism building, the legislative protection strength, etc. of the environment and resources legislative protection of the comprehensive grain production ability building in China. In order to protect natural resources and ecological environment and then increase the comprehensive grain production capacity, China should improve the grain-related environment and resources legislative protection system, build the grain-related environment and resources market mechanism, increase the grain-related environment and resources legislative protection strength under the guidance of the sustainable development view and the resources and environment security concept.
