包容性增长理念与司法的价值诉求*

公平正义是包容性增长的核心价值理念，也始终是司法的价值诉求。司法独立和司法受制都是保证司法公正的两个重要方面，但不同的时期不同的语境下应有不同的重点。考量当今中国的司法现状，观照司法权力的天然属性，只有加强司法权力的监控，才能确保包容性增长理念和司法公正的实现。

On the Concept of Inclusive Increase and Judicial Value

Fairness and justice are the core value concept of inclusive increase and also the appeal for judicial value. Independence of judicature and restriction of judicature are the two guarantees to the judicial fairness. However, the focus should be different under the different contexts at the different periods. According to the status quo of judicature in China and the nature of judicial power, the concept of inclusive increase and the judicial value will be realized under the supervision of judicial power.
