| 摘 要： | 结合白市驿板鸭商标侵权案论述了普通注册商标保护的积极意义与局限,对将政府资源(地理标志产品)、行业资源(证明商标或集体商标)、企业资源(一般注册商标)和农户资源优化整合的农产品知识产权保护优选路径进行了积极有益的思考和探索.

| Abstract: | Geographical indication is one of the intellectual properties that is highly related to the agricultural products which are in dualistic situation in our country.In this paper the duality pattern of protection with geographical indications of agricultural products in our country was explored and the positive significance and limitation of registration of trademark were discussed combined with the trademark infringement of Baishiyi duck,and the instructive reflection on the new optimization of the resources of the government,professon,enterprise and peasant household was made. |
