| 摘 要： | 黔东南苗族的传统习惯法中有存在一些具有独特作用的人和事物,如鬼师、理老、活路头、寨老和草标。笔者详细介绍了这些特定的人和事物在黔东南苗族中的存在,并对其进行分析,发现在市场经济的发展变化中这些民族习惯法也发生了很大的变化,在演变的过程中,有些甚至失去了原用的作用或被新的组织形式代替。通过对黔东南苗族习惯法变异与流失的研究,希望能够找到国家法与民族法之间的结合点,完善少数民族的法制建设。
