一起经营运输死因不明动物案引发的思考

病死动物无害化处理作为防控动物疫病的重要举措,对控制疫病传播、保障畜产品质量安全以及维护公共卫生安全意义重大。2016年甘肃省A县动物卫生监督所对一起涉嫌经营运输死因不明动物尸体案进行了立案查处,通过调查取证、价格函询、集体讨论,依据《动物防疫法》有关规定,对当事人依法处以15530元罚款。本文对案件查办过程中的货值金额认定、违法事实确认、证据材料审查、处罚条款适用等内容进行了重点评析,建议应严格落实畜禽标识佩戴义务,完善草原病死和死因不明牲畜收集体系,优化农业保险理赔流程。

Thoughts on a Case of Transporting and Selling Animals Died of Unclear Causes

As an important means to prevent and control animal diseases,bio-safety disposal of diseased and dead animals has been of great significance to control spreading of animal diseases,ensure quality and safety of animal products and maintain public health safety.In 2016,a case suspicious of transporting and selling animal carcasses with unclear death was investigated and punished by the animal health supervision institution in a county of Gansu Province.Upon investigation and evidence collection,price inquiry and collective discussion,the parties concerned were fined CNY 15530 in accordance with relevant provisions of the Law of the People's Republic of China on Animal Disease Prevention.In the paper,the determination of value of the goods,confirmation of illegal fact,review of evidence materials and application of penalty provisions in the process of investigation were analyzed,and some measures were put forward,including strictly wearing identification tags of livestock and poultry,improving the system for collecting animals dying of diseases or unknown reason in grasslands,as well as optimizing the claim process of agricultural insurance.
