论夫妻财产约定的法律适用

从夫妻财产约定的财产行为属性、《合同法》中的广义合同概念以及《合同法》、《婚姻法》和《物权法》的关系入手,分析了夫妻财产协议的性质、类型和效力。据此,提出了对夫妻财产协议进行区分的主张,夫妻财产协议并不仅限于约定财产制协议,应有约定财产制协议和其他财产协议的划分。夫妻财产协议符合约定财产制的条件时,适用《婚姻法》的规定;夫妻财产协议不符合约定财产制的条件时,则应当适用其他法律的规定。

On the Legal Application of Couple's Property Agreement

The quality,types and effect of couple's property agreement is analyzed from the property conduct attribute concerning the property agreement,the broad concept of contract in the contract law,and the relationship in contract law,marriage law and property law.The article points out that the couple's property agreement should not be limited to the contracted property ownership system.It should be divided into the contracted property ownership system and other property agreement.When the agreement about property complies with the contracted property ownership system,the regulation of marriage law should be applied;if it doesn't comply with the contracted property ownership system,other laws should be applied,which coordinates the legal application of couple's property agreement to the marriage law,contract law and property law.
