| 摘 要： | 新闻自由权与公平审判都具有宪法依据和同等价值。在司法审判中保障新闻自由,可借鉴外国的成熟做法,严格限定蔑视法庭罪和"限言令"的适用,以及规定不公开审判的条件等。在坚持新闻自由"保护为主,限制为辅"的原则基础上,通过制度建设实现司法公正,保障新闻自由权的充分行使。

| Abstract: | Both journalism freedom right and just trial hane lageal basis and values.logislative trials,journalisnv froedom should be ensured by learning foreign mature exercisos,by restriching the use of guilt contampting the coart and"prohibition of speech",and by daignating the condition of non-open trials.Based on the principle "protect first,estrict second",journalism foeedom is fully ensured by means of system building. |
