| 摘 要： | 凡具有共同作为义务的二人以上者,互相联络犯罪意思,进行违反其作为义务的不作为时,即为存在共同实行,能够成立不作为的共同实行犯。不作为的片面帮助犯罪非无一例外的排除在刑法的规制之外,当不作为同时构成违反特定职务或业务上之罪的正犯时,可按该罪的正犯处罚。

| Abstract: | When any two or above two persons,with the common conduct obligations,get in touch with their felonious intent,and deliberately omit performing their conduct obligations,then they shall be deemed as performing common practice,and be considered as common performance criminals.Not all ex parte assistant crimes of act of omission are excluded from the regulation of the Crime Law,when the act of omission meets the requirements of principal offender of certain duty or professional crimes,it may be considered as principal offender. |
