| 摘 要： | 我国耕地保护制度经过了耕地保护法律意识觉醒期、法律制度起步期、法律体系形成期、法律体系发展期的演进.我国耕地保护的法律形式、法律规范和法律手段在演变中完善,但当前的耕地保护法律制度面临经济建设与耕地保护、私益与公益的矛盾与冲突以及法律体系的不完善.完善我国耕地保护法律体系要以可持续发展为指导原则,以切实保护耕地和保障农民土地权益为主线,建议出台《耕地资源安全保障法》以树立耕地资源安全保障法律依据,并实现从国家到地方,从宏观到微观的一系列保护耕地数量、质量与生态安全的法律体系.
