| 摘 要： | 元明清时期基层社会秩序的维持，有着国家法和民族习惯法两套知识体系，但在表面二元性的关系结构中，国家法对习惯法的塑造和影响始终是主要方面。国家法对基层的治理和渗透一直与少数民族乡约的发展交织，基层法秩序呈现二元单维、三元交融的结构状态。

| Abstract: | There are two knowledge systems in terms of keeping legal order during Yuan-Ming-Qing Dynasty in grass-roots society,one is State Law,another is Folk Law.Seemingly dualistic positionality,the major aspect is always that State Law models and influences Folk Law.State Law governs and permeates grass-roots,mutually developing with ethnic village conventions.Grassroots legal order presents dual one-dimensional and three-in-one blend structure. |
