| 摘 要： | 我国城市建设过程中暴力拆迁与暴力反拆迁现象日趋严重的原因主要在于公权力的越位和错位,及公民权利的失位,并据此提出了完善拆迁听证程序、引入行政附带民事诉讼制度、完善拆迁补偿安置制度等若干建议,以防止暴力拆迁与暴力反拆迁.
