论汉语法律文献中主题句的英译

汉语和英语属于两个完全不同的语系,拥有截然不同的起源与文化背景,在词法和句法中有大量形式上的不对等之处。尤其法律汉语是TC语言,而法律英语是SV语言,从这一角度来探讨汉语法律文献的英译是本章的重点,也是本论文的新颖独到之处,前人多是对两种语言的法律法规的具体转变方法进行了很多例举,但几乎很少与英汉对比语言学相结合,而本文把两种法律语言的对比与对比语言学相结合进行研究,尤其是对汉语法规中无主句现象的分析与处理,作者做了深层探讨,突破了以往法律工作者单纯研究法律条文内容或者语言学家们单纯研究语言本身尤其是文学语言的局限,这将使法律法规翻译的许多译法能从对比语言学角度找到解释。

On Translation of TC Structure sentences in Chinese Legal Documents

Because of the totally dissimilar origins and cultural backgrounds, Chinese and English differ in many aspects. That is the very reason why translation from Chinese into English is by no means easy. It is necessary for translators to pay special attention to specific techniques for translating legal documents. Since China' s entry into the WTO, much attention has been given to EC legal translation, but the problem of the differences between the TC structure in Chinese and SV stnicture in English has almost never been probed into before. Chinese law is a topic-prominent language while English law is a subject-prominent language. How to transfer such dramatically fonnal non-equivalent languages is the key point of this chapter, which is the author' s original idea of this thesis as well. So the proper handling of TC structure in Chinese legal documents into SV stnicture in English is the author' s focus in this thesis.
