我国耕地行政法律保护制度的立法探析

耕地是人类生存和社会经济发展的基础。耕地行政法律制度实质是土地的行政管理制度。我国现行的土地行政法制度存在一系列问题:基本农田保护法律制度难以有效执行;征收和补偿制度显失公平;占补平衡制度在实际操作与立法目的相距甚远。从行政法律视角,借鉴美国、日本等发达国家经验,建议完善现行相关法律规定,构建科学合理的耕地行政法律保护制度。

Discussion on Legislation of the Cultivated Land Administrative Law Protection System in China

The cultivated land is the basis of human living,social and economic development.The cultivated land administrative law system is the land administrative management system essentially.There are a set of problems in the current land administration law system in China,such as difficulty in implementing the basic cropland protection system,unfair between land requisition and compensation systems,the gap between actual operation and legislation aim in implementing land requisition and compensation systems.The paper puts forward the suggestions including perfecting the current correlative law regulation and establishing the scientific and rational cultivated land administrative law protection system by using the experience of other developed countries for reference from the administrative law angle.
