从德国森林规章制度的发展看我国制定地方森林法或森林法地方执行细则的必要性

德国的森林法举世闻名.文章对德国的地区森林规章制度发展史进行了研究和分析,总结出取得成功的经验和特点:1.历史悠久,用森林规章治林长达千年,2.森林规章起源于地方,立足于地方,具有强烈的地方性;3.森林法制体现林业政策的稳定性,符合林业生产周期长的规律;4.林业政策和技术政策融合于森林法中,实现对各种所有制森林的科学管理。我国的森林法制基础薄弱。借鉴德国的经验,建议我国制定地方森林法或森林法执行细则,以健全法制,保证和促进林业的健康发展。

Local Forest Laws Are Needed in China

Germany is well known for its forest laws.The development history of regional forest rules and regulations in Germany are studied and analysed in this paper, and the experiences and characteristics for success are summarised: 1. a long history of a thousand years in running forest by rules and regulations; 2. forest regulations originated from and were based on localities, and therefore have strong local features; 3. forest legal system reflects the stability of forest policies, and conform to the law of long production cycle of forestry; 4. forest policies and technical policies are mixed with forest laws, all forests with different ownerships are managed scientifically. The author proposes that China should use Germany's experiences for reference,formulating local forest laws or detailed rules of the national Forest Law to promote healthy development of forestry.
