中国古代血亲复仇案件司法裁决影响因素及其当代镜鉴

为维护统治秩序的稳定,几乎各个朝代都通过立法明令禁止血亲复仇,而在司法实践中,法律并非影响这类案件裁决的唯一因素,通常还受到政治、社会文化以及个人因素等影响。在处理当代血亲复仇类案件时我们应以史为鉴：国家层面应完善立法、加强司法公信力建设、深化公民的法治信仰;社会层面应努力营造客观、理性的舆论氛围;审判人员自身也应加强理性思维的培养,由此促进血亲复仇案件的公正裁决并减少血亲复仇案件发生。

The Factors Influencing Judicial Decisions in the Blood Relative Vengeance Cases in Ancient China and Their Contemporary Significance

In order to maintain the stability of the ruling order, almost all dynasties in ancient China have enacted legislation to explicitly prohibit vengeance of blood relatives, but in judicial practice, the law is not the only factor affecting the decision of such cases. The political, social cultural and personal factors might also influence the decision. We should learn from history when dealing with contemporary blood relative vengeance cases:the state should improve legislation, strengthen judicial credibility, and deepen citizens'' belief in the rule of law; the society should strive to create an objective and rational environment for public discourse; and the judges themselves should strengthen the cultivation of their rational thinking, so as to arrive at fair decisions in such cases and reduce their occurrence ultimately.
