摘    要:航空碳排放对于气候变化的影响日益加剧,而欧盟为履行气候变化国际法要求的减排义务,实施了欧盟航空碳排放交易机制,欧盟目前暂停对非欧盟籍的航空器营运人适用这一机制但仍在观望,这对于我国而言是个潜在威胁。欧盟航空碳排放交易机制在气候变化国际法的框架内考量也构成非正当性,存在违反共同但有区别的责任原则、国际合作原则以及适用范围过宽这三个问题。因此,我国应坚持和强调气候变化国际法的核心内容,可在此范围内通过国际和国内层面采取适当的应对之策,保障我国航空运输的健康有序发展。

Abstract:The impact of aviation carbon emissions on climate change is becoming more and more serious.In order to fulfill the emission reduction obligations required by the international law of climate change,the European Union has implemented the EU aviation carbon emissions trading mechanism.Even though the EU currently suspends the application of this mechanism to non EU aircraft operators,it is still waiting,which is still a potential threat to China.The EU aviation carbon emissions trading mechanism also constitutes illegitimacy within the framework of climate change international law,which violates the principle of common but differentiated responsibility,the principle of international cooperation and the wide scope of application.Therefore,China should adhere to and emphasize the core content of international law on climate change,and take appropriate countermeasures at the international and domestic levels to ensure the healthy and orderly development of China′s air transport.
