试论种子质量认定的复杂性

由于种子自身特性和农作物生长过程的复杂性等原因,使种子真假优劣的认定比较困难,这一点可以从影响或制约种子作用发挥的内外因、认定的方法、标准与过程,以及法律的角度得到证明。在发生种子质量纠纷时,应持慎重的态度予以科学的分析,在技术手段难以解决时,应适用举证责任倒置的原则,由种子经营者承担证明种子质量的责任。科学、及时地认定种子质量,存在一定的复杂性,需要各方面共同努力。

Discussion on the Complexity of Congnizance about Seed Quality

As a result of the seed characteristics and the complexity of crops growth process,it is difficult to recognize the seed genuine or fake and good or bad quality.Therefore,once the seed quality was disputed,the prudent manner should be hold to give the science analysis.We should apply the principle to present evidence and undertake seed quality responsibility.The joint effort of various aspects was made to recognize the seed quality promptly and scientifically.
