| 摘 要： | 行政复议制度是我国解决行政纠纷的重要制度之一,其功能定位对行政复议制度实施
的效果具有重要作用。通过对行政复议制度功能定位在我国多种学说观点的分析与研究,不难
发现,行政复议立法目的与法治实践需求的不断变化推动其功能定位由最初的内部监督逐渐转
向权利救济、争议解决，并且最终向多元化功能方向发展。

| Abstract: | Administrative review system is one of the important systems for solving administrative dis?
putes in China. Through the analysis and research on the functional positioning of administrative review
system in various theories and viewpoints in China, it is not difficult to find that the constant changes of
the legislative purpose of administrative review and the practical needs of the rule of law promote its
functional positioning from the initial internal supervision to rights relief and dispute resolution, and
eventually to the direction of diversified functions. |
