农村土地制度对土地流转的影响研究

研究目的:现行农村土地制度对农村土地流转的影响。研究方法:文献阅读法和归纳总结法。研究结果:现行农村土地制度制约着农村土地流转,应从农村土地所有、使用、管理3个方面对农村土地制度进行创新和完善。研究结论:所有制度的创新是通过实行国家和农户双重所有,解决产权关系模糊问题,为农地流转提供制度基础;使用制度创新重点是确立农民在土地资源配置中的主体地位和作用,完善土地资源配置机制;管理制度创新的重点在于土地产权管理,建立有效的调控管理机制。

Rural Land System on the Impact of Land Transfer

The purpose is to study the impact of rural land the existing rural land system.The literature and induction methods are applied.The results show the existing rural land system restricts the rural land transfer,the rural land system should be innovated and improved from the three aspects of rural land ownership,use,management.The conclusion of the study shows the ownership systems should be innovated through the introduction of dual between state and farmers,to solve the ambiguous property rights,and to provide agricultural land for institutional basis;The focus of using system is to establish the dominant position and role of farmers in the allocation of land resources,to improve the land resource allocation mechanisms; management system focuses on innovation in the management of land property rights,to establish effective regulatory management system.
